Marsden Park Shotkoan Karate (MPSK) club training, competition, seminars and other Karate activities are deemed as a physical contact activity and involve physical contact with other club (or other Karate Associations) members. Due to the nature of Karate, physical and mental demands can be very high. Techniques are often delivered at high speed and participants are required to move with rapid change of direction. Also, due to the nature of training and competition participants may be required to train with and pair up or compete against others of mixed ranges of age, weight, height and skill levels.
In consideration of MPSK acceptance of your application to participate in this seminar activities, you voluntarily release, waive, and discharge MPSK and its instructors, agents and assistant instructors from any and all claims, losses, damages or demands for bodily injury, property damage, wrongful death, loss of consortium, or otherwise arising out of or relating to your participation in any MPSK related activities, even if caused by the negligent acts or omissions of MPSK, its instructors, assistant instructors, volunteers, and other members. This also applies to other non MPSK instructors and participants at the seminar.
Various musculoskeletal injury may result due to high velocity and high impact movement. Also unintentional physical contact may result during technique delivery, evasion or application of unbalancing or counter techniques. Physical contact whilst blocking or grappling is inherited to Karate participation.
As a participant in this seminar, you agree to follow the directions of the instructor and his assistants at all times.
By accepting these Terms and Conditions, you understand and agree that:
(a) These Terms and Conditions will have the effect of releasing, discharging, waiving, and forever relinquishing any and all actions or causes of action that you may have or have had, whether past, present, or future, whether known or unknown, and whether anticipated or unanticipated by you, arising out of your participation in any MPSK related activities including this seminar.
(b) You are assuming full responsibility for any and all risk of death or personal injury or property damage you suffer while participating in any MPSK related activities and seminars.
(c) These Terms and Conditions will be binding on you, your spouse, your heirs, your personal representatives, your assigns, and your children.
(d) You are agreeing to indemnify, defend and hold MPSK, its instructors, assistant instructors, members, volunteers, other clubs instruyctors and participants and agents harmless from any and all liability or costs, including attorneys’ fees and costs, associated with or arising from your participation in any MPSK related activities including this seminar.
